New Legislation Clarifies Recording Fees Question

On Tuesday, March 13th, California Governor Jerry Brown signed Assembly Bill 110 (AB 110), clarifying local child support agencies and other government entities are exempt from recording fees.

AB 110, effective upon the Governor’s signature, applies to any real estate documents that have been officially placed in county records after January 1, 2018. The precursory bill, Senate Bill 2 (SB 2), imposed a $75 fee on these documents that was to be paid upon the time of recording as a way to fund affordable housing. However, the fees were never meant to apply to local child support agencies or government entities. With the signing of AB 110, local child support agencies can return to the standard lien release processing fees of eight dollars, as provided by existing law.
